Terms and Conditions of Sales
1. General Information
These Terms and Conditions of Sale (“Terms”) govern all purchases made through http://www.thurjehandmade.com, operated by Mikaela Maçka PF (NIPT: M01808005D), trading as Thurje Handmade, with registered address at Baba Meleq, Old Bazaar, 7001 Korça, Albania and contact email contact@thurjehandmade.com.
By placing an order on our Website, you agree to be bound by these Terms. Please read them carefully before completing a purchase.
2. Products
Thurje Handmade sells handmade rugs and textile accessories, which fall into two categories:
– Ready-made products: items available for immediate purchase from our existing collection.
– Custom / made-to-order products: items produced specifically according to the customer’s specifications (dimensions, colours, design).
All products are handcrafted by artisans. Minor variations in colour, texture and dimensions compared to product photographs are inherent to the handmade nature of our goods and do not constitute defects.
Product descriptions, dimensions and prices are provided in good faith and are subject to change without prior notice. Prices are shown in Euros (EUR) and are inclusive of any applicable VAT where required.
3. Placing an Order
To place an order you must be at least 18 years of age or have the consent of a parent or guardian. By submitting an order, you confirm that you have read and accepted these Terms.
After placing your order, you will receive an order confirmation email. This email acknowledges receipt of your order but does not constitute acceptance. The contract of sale is formed when we send you a shipping confirmation email confirming that your order has been dispatched.
We reserve the right to refuse or cancel any order, for example in cases of pricing errors, unavailability, suspected fraudulent activity, or inability to process payment. You will be notified promptly and any payment made will be refunded in full.
4. Prices and Payment
All prices are displayed in Euros (EUR). We accept the following payment methods:
– PayPal (including credit and debit card payments via PayPal)
– Direct bank transfer (IBAN details provided at checkout)
Payment must be received in full before orders are dispatched. For bank transfer orders, dispatch is subject to payment clearance, which may take 2–5 business days.
We are not responsible for any fees charged by your bank or payment provider for currency conversion or international transactions.
5. Shipping and Delivery
5.1 Shipping Destinations
We ship to Albania and internationally, including all European countries, the United States, and Canada. If your delivery address is not within these regions, please contact us before placing an order.
5.2 Shipping Carriers
We ship via the following carriers:
– Albanian Post: used primarily for shipments within Albania.
– DHL: used for international shipments.
5.3 Shipping Costs
– Albania: free shipping on all orders.
– International: shipping costs are calculated at checkout based on the weight, dimensions and destination of your order.
5.4 Delivery Times
Estimated delivery times from dispatch are:
– Albania: 1–2 business days
– International: 1–4 business days
These are estimates only and are not guaranteed. Delivery times may be affected by customs processing, public holidays, adverse weather, or carrier delays. Thurje Handmade accepts no liability for delays beyond its reasonable control.
Custom/made-to-order products require additional production time before dispatch. Estimated production times will be communicated at the time of order.
5.5 Customs, Duties and Taxes
For deliveries outside Albania, customs duties, import taxes or other charges may be levied by the destination country. These charges are the sole responsibility of the recipient. Thurje Handmade has no control over these charges and cannot predict their amount. We recommend consulting your local customs authority for information.
6. Returns, Exchanges and Refunds
6.1 Right of Withdrawal — Ready-Made Products
If you are a consumer resident in the European Union or European Economic Area, you have the right to withdraw from your purchase without giving any reason within 14 calendar days of receiving the goods (the cooling-off period), in accordance with EU Directive 2011/83/EU on consumer rights.
To exercise this right, you must notify us within the 14-day period by sending a clear written statement to contact@thurjehandmade.com indicating your decision to withdraw. You may use the following model statement:
“I/We hereby give notice that I/we withdraw from my/our contract of sale of the following goods: product name and order number, received on [date], Name: [name], Address: [address], Date: [date].”
Once we have received your withdrawal notice, we will send you return instructions. You must return the goods within 14 days of your withdrawal notice. Return shipping costs are at your expense, unless the item is defective or we sent the wrong item.
Items must be returned in their original, unused condition with all original packaging. We reserve the right to deduct from the refund any diminution in value resulting from handling beyond what is necessary to establish the nature and functioning of the goods.
We will process your refund within 14 days of receiving the returned goods or proof of return shipment, whichever is earlier. Refunds will be made using the same payment method used for the original transaction.
6.2 Custom and Made-to-Order Products — No Right of Withdrawal
Custom and made-to-order products are specifically created to the customer’s specifications. In accordance with GDPR Art. 16(1)(c) of EU Directive 2011/83/EU, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.
Orders for custom products cannot be cancelled once production has begun. Please carefully review all specifications (dimensions, design, colours) before confirming your order. If you have any doubts, contact us at contact@thurjehandmade.com before ordering.
6.3 Defective or Incorrect Items
If you receive a defective, damaged or incorrect item, please contact us at contact@thurjehandmade.com within 7 days of delivery, providing your order number and photographs of the issue. We will arrange a replacement or full refund at no additional cost to you, including return shipping charges where applicable.
7. Liability
Thurje Handmade is not liable for:
– Damage or loss resulting from improper use or care of products contrary to the care instructions provided
– Delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, strikes, pandemics, or carrier failures
– Any indirect, special or consequential loss arising from the use of products or the Website
Our total liability to you in connection with any order shall not exceed the total amount paid for that order.
8. Dispute Resolution
In the event of a dispute, we encourage you to contact us first at contact@thurjehandmade.com so that we can try to resolve the matter amicably.
If you are an EU consumer, you also have the right to submit a dispute to an Online Dispute Resolution (ODR) platform provided by the European Commission, accessible at: https://ec.europa.eu/consumers/odr.
9. Governing Law
These Terms are governed by and construed in accordance with Albanian law. For consumers in the EU/EEA, mandatory consumer protection provisions of your country of residence remain applicable and are not affected by this clause.
10. Modifications
We reserve the right to modify these Terms at any time. Changes take effect upon publication on the Website. Orders placed before the date of any change will be governed by the Terms in effect at the time of the order.
